Jail Time no longer a means of punishment in South Korea!
Interesting fact, who would have thought that you could go to Jail for committing adultery. Well it turns out that is, or rather was the case in S. Korea until recently. Adultery was seen as a criminal offence and one could go to prison for up to two years, though only a small percentage were sent to jail. This criminal law that was punishable by law was in effect for 62 years, but as of February 26th, the Constitutional Court of Korea ruled it unconstitutional by seven votes to two votes.
It also turns out there have been several appeals to consider the constitutional legality of marital infidelity, the last time being in 2008. With the heated debate over the controversy of legalizing adultery, a lot of people are having mixed feelings. Some feel this is a more private matter, which should be looked into by the civil law not criminal law. But others feel this would be a disadvantage and a law is being removed, which should protect the family.
I wonder whether that law was useful to the people of S. Korea in any way, and whether they had less adultery or if it had an effect on their divorce rate. Of course Adultery is only known if someone gets caught, so one can never be sure. As for KDramas, a lot of the stories included adultery, which was punishable by law but writers will no longer be able to do so in their episodes.
